Prosecutors Decide Against Charges in Tragic Disney Cruise Ship Incident Involving 5-Year-Old
Prosecutors have decided not to press charges against a mother whose 5-year-old daughter fell overboard from a Disney cruise ship in June. The incident, which garnered significant attention, unfolded on June 29 while the Disney Dream was en route from the Bahamas to Fort Lauderdale.
According to an investigation, the young girl had been posing for pictures near an open porthole when she climbed onto the railing to get a better view. Tragically, she lost her balance and fell about 49 feet into the ocean. At the time, her father was walking ahead and leaped into the water upon hearing the mother’s scream, successfully retrieving his daughter.
Both the father and daughter were rescued within 20 minutes of the incident, but they required medical attention— the girl for mild hypothermia and minor lactic acidosis, and the father for more severe reactions including hypothermia and spinal fractures.
The state attorney’s report acknowledged that while the mother’s actions were “arguably negligent and irresponsible,” they did not meet the threshold for criminal culpability. She was taking photos and did not realize the danger until it was too late. According to the report, this was deemed an isolated incident stemming from a momentary lapse in judgment.
